A. Service Areas Established: The city council and the data contained in the city's sewer and storm sewer capital facilities plans, together with the applicable requirements of state law, the city council finds that there should be, and there are hereby established, sewer and storm sewer impact service areas which areas are described by the geographic boundary of the city of Plain City, Utah, as presently constituted and as those boundaries may, from time to time, be lawfully modified.
B. Sewer Impact Fee Enacted: The city council finds that there should be, and there is hereby enacted a sewer impact fee for the above established sewer impact service area beginning August 16, 2006, together with a storm sewer impact fee for new homes beginning immediately for the above established storm sewer impact service area, said fees having been determined to comport as required with applicable law and the findings of the sewer and storm sewer capital facilities plans.
