A. Animal Control Department Created: The city council has created the animal care and control department, a subdepartment of the police department, or any agency engaged to provide city police services, for the purpose of resolving animal related disputes in the incorporated areas of the city. The department shall participate in the disposing of the same. (1982 Code § 13-202; amd. 2003 Code)
B. Power And Authority Of Animal Control Officials: The animal control director, and/or person employed by the department of animal control, as an animal officer, shall take the oath of office and shall be vested with the power and authority to enforce this chapter.
C. Right Of Entry For Enforcement: In the enforcement of this chapter, all peace officers or animal control officials, are hereby authorized to enter onto the open premises of any person or entity to take possession of any animal in violation of this chapter and/or to enforce the same.
D. Interfering With Officers Prohibited: It is unlawful for any person to knowingly and intentionally interfere with the director or any animal control officer in the lawful discharge of his duties as prescribed in this chapter.
E. Animal Shelter Provided: The city council shall provide suitable premises and facilities to be used as a city animal control shelter wherein impounded animals can be adequately kept. The city shall also purchase and supply adequate food for all impounded animals. (1982 Code § 13-202)
