In the event the responsible party fails or refuses to pay all of the costs and expenses determined by the city related to or arising out of the city's response to the hazardous materials emergency within thirty (30) days after assessment or after the governing body's decision on an appeal, the city may initiate a legal action to recover such costs, including reasonable attorney fees and costs.
