951.04 COLLECTION AND DISPOSAL.
   (a)    Residential Disposal. All residential solid waste shall be collected by and disposed of by the Village or its contractor.
   (b)    Nonresidential Disposal. All solid wastes and other waste from commercial, industrial, institutional and other nonresidential premises, including apartments and condominium complexes with more than two units, shall be collected by and disposed of by person, firms or corporations authorized to do so in accordance with the provisions of Section 951.11 .
   (c)    Individual Disposal. The disposal of solid wastes in any quantity by any individual, householder or establishment in any place, private or public, within the Village limits or within not more than 5,000 feet outside of the Village limits, is prohibited except by persons licensed to do so in accordance with the provision of this chapter.
   (d)    Placing and Maintenance of Containers. 
      (1)    Solid waste containers shall be stored inside a building or in the rear yard of any public or private premises as authorized by the Village Administrator.
      (2)    Containers and recycling bins from residential premises shall be placed at the street, curb, tree lawn, alley way or other collection location approved by the Village Administrator no earlier than 6:00 p.m. the evening before the day of collection. However, where it can be shown that the owner, occupant, tenant or lessee of any public or private premises cannot, by reason of age, infirmity or other disability, place containers and recycling bins for collection at the place designated herein, suitable arrangements for their collection shall be made by the Village Administrator or his authorized representative.
      (3)    All containers and recycling bins shall be returned to the place of storage within twenty-four hours from the time of collection. Containers and recycling bins remaining at the collection location after the time provided for herein may be removed by the Village or its contractor. The owner of such containers shall have one week within which to reclaim such containers. Thereafter, such containers may be disposed of by the Village or its contractor.
      (4)    Containers and recycling bins shall be maintained in a safe and sanitary condition and in the event that containers are not so maintained, the Village Administrator, or his duly authorized agent, shall notify the owner thereof, and such owner shall repair, disinfect or replace the containers, within three days of the receipt of such notice. If such containers are not placed in a sanitary and/or safe condition, the containers may be collected at the option of the Village and either disposed of or rendered safe and returned to the owner. If rendered safe or repaired, the owner will be charged a fee not to exceed the amount necessary to cover the actual cost of labor and materials.
   (e)    Miscellaneous. 
      (1)    The Village or its Contractor shall tag all containers which are unauthorized or unserviceable, and which do not have serviceable handles for lifting and carrying, which have holes in the bottom, or which are otherwise not suitable for use. Such tags shall advise the subscriber of the reason why the container may not be used.
      (2)    The Village or its Contractor shall exercise reasonable caution in the handling of the containers to avoid damage to the same, and shall return empty containers to the point of collection, in an upright condition. Refuse or garbage spilled by the Village or its Contractor shall be immediately picked up, or swept up, by the Contractor.
      (3)    Neither the Village nor its Contractor shall be held responsible for plastic cans of insufficient strength which may crack from exposure to freezing temperatures.
