(a) In recognition of the need for the establishment of a public body with authority to act upon changes to structures in the District and in order to encourage changes that are compatible with the restoration movement now in progress, the Uptown Plain City Historic District Design Review Board is hereby established.
(b) The Board shall consist of seven (7) members, who shall be appointed by the Mayor with the advice and consent of Council. All potential members nominated shall have experience with, demonstrated an interest in, or knowledge of, historic preservation.
(c) Whenever possible, at least five (5) members shall be residents of the Village of Plain City. The remaining two (2) members shall be residents, property-owners, or owners/managers of a business within the Village. Whenever possible, the appointments should be made so that the following qualifications are represented by the total membership of the Board.
(1) A representative of the Uptown Plain City Organization;
(2) A member of the Plain City Historical Society;
(3) One (1) Historic District property owner;
(4) A person with a construction background;
(5) An architect;
(6) A real estate agent; and
(7) A Council member or designee.
(d) Members shall be appointed to serve three-year terms, except in the initial year when two (2) members shall have one-year terms, two (2) members shall have two-year terms, and three (3) members shall have three-year terms. Members shall serve until their successors have been named and qualified. A majority of the membership of the Board shall constitute a quorum.
(e) Members shall serve without any compensation, either monetary or otherwise.
(f) Members of the Board shall be removable for nonperformance of duty, misconduct in office or other cause by Council upon written charges having been filed by the Mayor with Council and after a public hearing has been held regarding such charges, a copy of the charges having been served upon the member so charged at least ten days prior to the hearing, either personally, or by registered mail, or by leaving the same at his usual place of residence. The member shall be given an opportunity to be heard and answer such charges.
