Every record owner of any premises, tree or plant infested with pear psylla who has been served with the written notice as provided in section 7-7-2 of this chapter who refuses, fails or neglects to eradicate, destroy or control, to the satisfaction of the agricultural commissioner, the pear psylla within the time specified in the notice is subject to penalty section 1-4-5 of this code.
