For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
REGISTERED SOLICITOR
. Any person who has obtained a valid Certificate of Registration, as provided in the following subchapter, and who has the certificate in his or her possession while soliciting.
RESIDENCE
. Every separate living unit occupied for residential purposes by one or more persons, contained within any type of building or structure.
SOLICITING
. Any one or more of the following activities:
(1) Seeking to obtain orders for the purchase of goods, wares, merchandise, foodstuffs or services of any kind for any consideration;
(2) Seeking to obtain prospective customers for application or purchase of insurance of any type;
(3) Seeking to obtain subscriptions to books, magazines, periodicals, newspapers and every other type or kind of publication;
(4) Seeking to obtain gifts or contributions of money, clothing or any other valuable thing for the support or benefit of any charitable or nonprofit association, organization, corporation or project;
(5) Selling goods or services door to door or peddling goods or services; and
(6) Seeking to obtain gifts or contributions of money, clothing or any other valuable thing for the support of any person other than a charitable or nonprofit association, organization, corporation or project.
SOLICITOR. A person engaged in the practice of soliciting. SOLICITORS shall be divided into the following classes:
(1) Class A. Solicitors who represent charitable or nonprofit organization which are named on a list of the organizations on file in the office of the State Attorney General.
(a) Class A solicitors may engage in soliciting only between the hours of 9:00 a.m. and
6:00 p.m.
(b) With the exception of this section, the provisions of Chapter 113 shall not apply to Class A solicitors.
(2) Class B. Solicitors who are not Class A solicitors.
