Where a subdivider can show that a provision of this chapter would cause unnecessary hardship if adhered to and where, because of topographical or conditions peculiar to the site or surrounding conditions and in the opinion of the Plan Commission a departure may be made without destroying the intent of the provision, the Commission may recommend approval of a variance.
(A) Any variance recommended shall be entered minutes of the Commission with the reasons therefor set forth upon which the variance is considered justified.
(B) A certified copy of the minutes shall be forwarded to the City Council for approval or rejection of the variance.
