§ 96.41 RESTORATION.
   (A)   Whenever any excavation shall be made in any street or alley in the city for the purpose of a water or sewer connection or for any other purpose, the excavation shall be carefully and promptly filled by the person making the excavation or causing it to be made. When the purpose of the excavation has been accomplished, the dirt shall be packed and tamped in such a manner that the inconvenience attending the settling thereof shall be reduced to the minimum and the street or alley shall be, so far as possible, restored to the same condition as before the excavation was made.
   (B)   Should any person, having made or caused to be made an excavation in any street or alley of the city, fail or neglect to restore the street or alley as provided in division (A) above, the city shall proceed and restore the street or alley to its proper condition and the expense thereof shall be charged to the person making or causing the excavation to be made, which expense may be collected by the city by action at law.
