(A) All original sidewalk construction within the city after June 1, 1956, may be constructed with equal participation between the city and the property owner or the person desiring the sidewalk, if the city's share is properly appropriated and funds are available.
(B) Division (A) above shall not apply where there are no existing streets or a subdivision where the Plan Commission has jurisdiction.
