§ 31.77 DUTIES.
   The duties of the City Attorney shall include the following:
   (A)   Be the legal adviser to the City Council;
   (B)   Draft ordinances as the Council authorizes or at the request of the Mayor, a Council committee or an Alderman;
   (C)   Draw all leases, deeds, contracts or other legal documents at the direction of the Mayor or the Council;
   (D)   Advise the Council, the Mayor or other city officials on all matters of law in which the interests of the city are involved and may, when the Attorney considers it of sufficient importance, raise questions to be submitted in writing and, in such cases, his or her answers shall be in writing;
   (E)   Take charge of all actions for violations of the provisions of this code or other ordinances of the city in the courts in which they are brought and to which they may be appealed;
   (F)   Institute the prosecution of all violations of the provisions of this code or other city ordinances when directed by the Mayor, the Council, the Chief of Police or any other enforcement officer of the city or when any complaint has been filed with an appropriate court;
   (G)   Prosecute any action arising from violation of the provisions of this code or other city ordinances or the Illinois Compiled Statutes when, upon investigation thereof, he or she shall be satisfied the complaint was not instituted maliciously and is not without probable cause;
   (H)   Prosecute or defend, as the case may be, other cases in which the interests of the city are involved. Those cases shall be considered beyond the normal duties of the Attorney;
   (I)   Dismiss suits or proceedings upon terms he or she may deem appropriate, when he or she considers the public interests will be served properly. Before dismissal, the proposed action shall be reported to the Mayor and Council;
   (J)   Be the parliamentarian of and for the Council;
   (K)   Recommend to the Council, from time to time, the passage of ordinances he or she deems necessary and proper for the safeguard of the public health, safety and welfare.
