(A) No person, firm or entity shall dispose, dump or deposit any tree, bush, shrub, tree limb, tree trunk, stump or brush upon any property of the city, including the city brush yard, except in accordance with rules and regulations set forth herein.
(B) Any person, firm or entity working for profit in the business of tree trimming desiring to dispose of trees, bushes, shrubs tree limbs, stumps, tree trunks, or brush shall first obtain an annual permit from the City Clerk's Office and pay the fee set forth below at Pittsfield City Hall.
(C) Each disposal permit shall be signed by the authorized person for the person, firm, or entity conducting the disposal activity, who shall, in addition to the firm or entity, be individually responsible for compliance with all rules and regulations governing disposal.
(D) Each disposal permit shall contain the following information for each person, firm, or entity seeking a disposal permit:
(1) Name and name of responsible person if a firm or other entity;
(2) Physical address of such person, firm, or entity (no post office boxes);
(3) Telephone number at which the person, firm or entity may be reached during daytime hours;
(4) Any additional information required by the City Clerk.
(E) The annual permit fee to be charged for each permit for disposal of trees, bushes, shrubs, tree limbs, tree trunks, stumps, or other brush shall be $1,000. Permits shall be issued on the first day of May of each year and shall expire on the last day of April of the following year.
(F) Any person, firm or entity reasonably believed to have violated any rule or regulation contained herein or any directive provided by the Public Works Director, or her or his designee, shall have their privilege to obtain disposal permits and to dump or dispose, as provided herein, suspended for up to 30 days. The Public Works Director shall provide written notice of such suspension.
(G) Any person, firm or entity reasonably believed to have violated any rule or regulation contained herein on two or more occasions shall be permanently barred from dumping or disposing of trees, bushes, shrubs, tree limbs, tree trunks, stumps and brush at the city brush yard. Written notice of debarment shall be issued by the Mayor, Chief of Police or their designee.
(H) Nothing in this section is intended to prevent or prohibit a city resident from depositing trees, shrubs, limbs or brush cut or trimmed by the resident from his or her own property at the city brush yard or on the right-of-way adjoining the property for pick up by city personnel.
