§ 110.14 SPECIAL EVENTS LICENSES.
   (A)   Class S “Special Events”. A special event license shall permit the sale and offer for sale at resale, alcoholic liquors for use or consumption, but not for resale in any form and only at the location and on the specific, limited, dates designated for the special event in the license. A special event license shall be for wine and/or beer only.
   (B)   There shall be two categories of special events licenses as follows.
      (1)   Class S-1: “Special Event Not-For-Profit.”
         (a)   For purposes hereof, “Special Event Not-For-Profit” means an event conducted by an educational, fraternal, political, civic or religious or non-profit organization.
         (b)   An applicant for a special event not-for-profit retailer license must furnish with the application:
            1.   A resale number issued under § 2c of the Illinois Retailers’s Occupation Tax Act or evidence that the applicant is registered under § 2a of the Retailers’ Occupation Tax Act;
            2.   A current, valid exemption identification number issued under § 1g of the Retailers’ Occupation Tax Act, and a certification to the Mayor that the purchase of alcoholic liquors will be a tax-exempt purchase; or
            3.   A statement that the applicant is not registered under § 2a of the Retailers’ Occupation Tax Act, does not hold a resale number under § 2a of the Retailers’ Occupation Tax Act and does not hold an exemption number under § g of the Retailers’ Occupation Tax Act, in which event the Mayor shall set forth on the special event retailer’s license to that effect.
      (2)   Class S-2: “Special Event (for Profit).” For purposes hereof, a “Special Event (for Profit)” license means a license issued for a special event for any person, firm, business or entity other than a not-for-profit entity, as defined above.
   (C)   In addition to such other requirement as may be hereafter be specified, a Class S license shall be subject to the following conditions.
      (1)   The application for the special event license shall identify the purpose of the special event, the location where the alcoholic liquor is to be distributed for use of consumption, the duration for which the license is sought and other information as is required by City Ordinance.
      (2)   A special event license may also be issued to allow sales and consumption of alcoholic beverages out-of-doors on the public right- of-way. This may also be allowed only with specific approval of the Mayor and/or Local Liquor Control Commissioner under the guidelines approved by the City Council in advance of the date of the license.
      (3)   The fee for such license shall be $50 per day. A special event license may be issued for not more than three consecutive days and not more than three licenses annually.
      (4)   Each application must be accompanied by proof of proper insurance.
      (5)   A special event license shall not be issued to any person, firm or corporation holding a city liquor license.
      (6)   No special event licensee shall be issued any other license for 30 days after the expiration of the event.
      (7)   The city Mayor and Liquor Commissioner shall have authority to grant or deny the application.
