1113.05 FINAL PLAT.
   (a)   The final plat shall be filed with the Village Council not later than twelve months after the date of approval of the preliminary plat; otherwise it will be considered void unless an extension is requested by the subdivider and granted in writing by the Village Council. Filing shall be at least 14 days preceding the monthly meeting of the Village Council to be considered at that meeting.
 
   (b)   The Village Council shall approve or disapprove the final plat within 30 days after it has been filed. Failure of the Village Council to act upon the final plat within such time shall be deemed as approval of the plat. If the plat is disapproved, the grounds for disapproval shall be stated in the records of the Village Council, and a copy of said record shall be forwarded to the subdivider. The Village Council shall not disapprove the final plat if the subdivider has done everything that he was required to do and has proceeded in accordance with the conditions and standards specified in the approved preliminary plat.
   (c)   Following approval of the final plat by the Village Council, the subdivider shall comply with one of the following sections.
      (1)   Install all improvements required in the final plat, in strict compliance with all drawings and/or specifications.
      (2)   Furnish a performance bond in an amount of one hundred percent (100%) of the estimated cost of the proposed improvements to ensure to the Village Council that all work will be completed as shown.
      (3)   In lieu of a performance bond, a cash escrow account may be used. The amount of the cash escrow shall be as determined by the Village Council.
      (4)   In lieu of a performance bond, an “irrevocable” letter of credit may be used.
   (d)   The final plat as approved by the Village Council shall be filed in the office of the Recorder of Williams County, Ohio, within 3 months. If said plat is not recorded within 3 months, the approval of the Village Council shall be null and void.
