(a) Definitions.
(1) “Developer” means the owner of any property within the Village that is having placed upon it any “new construction project”.
(2) “New construction project” means any building newly constructed by a developer for resale. “New construction project” does not include any refurbished, remodeled or reconditioned building or any building that has had any occupant at any time, nor any building constructed for any use of the developer other than resale within six (6) months.
(3) “Occupant” means any person, organization or entity who has entered into any agreement, oral or written, for the purchase, lease or rental of the new construction project.
(b) No fees imposed by this chapter shall be due to the Village by any developer until such time as the new construction project has an occupant or the developer requests that service be turned on.
