(a) The authority and the requirement for the Municipality to recover, manage and disburse portions of Federal grant funds attributable to the costs of construction of those portions of public Wastewater Works used by, or reserved for, industrial users is contained in the Federal Water Pollution Control Act, Federal Water Pollution Control Act Amendments of 1972 (PL 92- 500), the Clean Water Act of 1977 (PL 95-217) and subsequent amendments, regulations and guidelines implementing these acts.
(b) Resolution No. 1-1976, as adopted by Municipal Council and dated January 12, 1976, authorizes and directs the preparation of an Industrial Cost Recovery System in conformance with Title 40 of the Code of Federal Regulations Part 35 as amended.
(c) Resolution No. 1-1976, as adopted by Municipal Council and dated January 12, 1976, provides assurance to the U.S. Environmental Protection Agency that the Municipality will adopt regulations for Industrial Cost Recovery as required by Part 35 of Title 40 of the Code of Federal Regulations pursuant to Section 204(b) of the Federal Water Pollution Control Act Amendments of 1972.
