(a) No child under the age of sixteen years shall loiter, idle, wander, stroll, play or be in a motor vehicle in, upon or about the public streets, sidewalks and parks, public buildings and grounds and public places of amusement and entertainment or other unsupervised places in the Village of Pioneer between the hours of 11:00 p.m. and 6:00 a.m. of the following day, Village time, unless accompanied by a parent, guardian or some responsible person over the age of twenty-one years having the care and custody of said child.
(b) No child between the ages of sixteen and eighteen years shall loiter, idle, wander, stroll, play or be in a motor vehicle in, upon or about the public streets, sidewalks, and parks, public buildings and grounds and public places of amusement or entertainment or other unsupervised places in the Village of Pioneer between the hours of 12:00 midnight and 6:00 a.m. of the following day, Village time, unless accompanied by a parent, guardian or some responsible person over the age of twenty-one years having the care and custody of said child.
(c) No parent, guardian, or person charged with the care and custody of any child under the age of eighteen shall knowingly permit said child to violate the provisions of this ordinance or neglect to restrain or prevent such child from violating the provisions of this section.
(d) It shall not be a violation of this section if any child subject to the curfew of the section is upon an emergency errand or legitimate business directed by said child’s parent, guardian or other adult person having the care and custody of said child.
(e) School, church, lodge, or other organization which desires to hold any meeting or entertainment for children under the age of eighteen years which requires children to be out at a later hour than that called for in this section shall make application to either the Mayor or Village Chief of Police for permission to have said children stay out to this later hour. Said application shall state the hour the entertainment will end and children who attend said function shall be off public streets, alleys, or highways one-half hour after said function is ended.
(f) Any child past the age of sixteen years who has a working certificate and whose work may require him to be out at hours later than those specified in this section may make application to the Mayor or the Village Chief of Police for written permission. Said Mayor or Village Chief of Police may grant permission, but said child shall not be out later than one-half hour beyond the time that said child’s work ends.
(g) Any child found in violation of the provisions of this section shall be taken to the Pioneer Municipal Building and the parent, guardian or person charged with the care and custody of said child shall be notified to come to the Pioneer Municipal Building and take personal charge of said child, and said child shall be released only to such parent, guardian or person charged with the care and custody of such child, or to the juvenile authorities. Any child found in violation of this section who has before been found in violation of this section shall be held for the juvenile authorities for proper disposition. Any parent, guardian or person charged with the care and custody of a child who knowingly permits said child to violate any provisions of this section or neglect to restrain or prevent said child from violating any of the provisions of this section shall upon the first offense be warned; upon the second offense shall be fined not less than ten dollars ($10.00) and not more than twenty-five dollars ($25.00) and upon any subsequent offense shall be fined not less than twenty-five dollars ($25.00) and not more than fifty dollars ($50.00) and shall pay the costs of the prosecution.
