A. The provisions of this title and other applicable provisions of this code shall cover all matters affecting or relating to buildings and structures. The provisions of this title shall apply whether or not the property, as defined in the condominium property act, 765 Illinois Compiled Statutes 605/1 et seq., is subject to the act. B. A building or structure shall not be constructed, extended, repaired, removed or altered in violation of this title, except for ordinary repairs as defined in section 10-1-3 of this chapter.
C. Any requirement essential for structural, fire or sanitary safety of an existing or proposed building or structure, or essential for the safety of the occupants thereof and which is not specifically covered by this title, shall be determined by the building commissioner. The building commissioner shall have the discretion, unless otherwise directed by the board of trustees or prohibited by law, to waive or modify any requirement or provision of this title if, in his opinion, the circumstances so warrant and the waiver or modification would serve the best interests of all parties concerned.
D. The continuation of work thereon, occupancy or use of a building or structure, or a part thereof, contrary to the provisions of this title shall be deemed a violation subject to the penalties prescribed in section 10-1-9 of this chapter. (1990 Code §16.201)
