9-5-2: PRIVATE WASTEWATER TREATMENT FACILITIES:
   A.   Discharging To Watercourse Prohibited: No person shall construct a wastewater treatment facility within the village, or in any area under the jurisdiction of the village, for the purpose of treating wastewater and discharging same to a watercourse.
   B.   Industrial Wastes: No person shall construct a wastewater treatment facility within the corporate limits of the village for the purpose of treating industrial wastes unless the village board determines that the existing wastewater treatment facilities have inadequate capacity and issues a permit for the construction and operation of a wastewater treatment facility. No village permit shall become effective until:
      1.   An IEPA permit to construct and operate the facility has been received.
      2.   An NPDES permit has been received.
      3.   The village engineer has approved the plans and specifications in writing.
      4.   The guarantee period has expired.
   C.   Subsurface Disposal:
      1.   No person shall construct a private wastewater treatment facility with subsurface disposal of the effluent if the population to be served exceeds ten (10) persons or the system is intended to serve more than one building.
      2.   Where a public sewer is not available, a private wastewater treatment facility employing subsurface absorption facilities may be installed, if the wastewater to be treated is from a residence.
      3.   Before commencement of construction of a private wastewater treatment facility employing subsurface absorption facilities, the owner shall first obtain a written permit. The applicant shall supplement by any plans, specifications and other information as deemed necessary. A permit and inspection fee shall be paid at the time the application is filed, and shall be in such amount as the village may from time to time determine. The permit shall not be issued until applicable county permits are on file with the village.
      4.   A permit for a private wastewater treatment facility employing subsurface absorption facilities shall not become effective until the installation is completed to the satisfaction of the village. (Ord. 2008-13, 4-7-2008)
