6-8-3: ACCESSIBILITY TO GRAFFITI IMPLEMENTS OR PARAPHERNALIA:
   A.   Furnishing To Minors Prohibited:
      1.   It shall be unlawful for any person, other than a parent or legal guardian, to sell, exchange, give, loan, or otherwise furnish, or cause or permit to be exchanged, given, loaned, or otherwise furnished, any graffiti implements or paraphernalia to any minor without the written consent of the parent or legal guardian of such minor.
      2.   It shall be unlawful for any retail commercial establishment to sell any graffiti implements or paraphernalia to any minor.
   B.   Signage Required: Every person who owns, conducts, operates or manages a retail commercial establishment that offers for sale or trade graffiti implements or paraphernalia shall:
      1.   Place a sign in clear public view at or near the display of such products or materials stating as follows:
Graffiti is against the law. Any person who defaces real or personal property with paint or any other liquid or device is guilty of a crime punishable by a fine of not less than One Thousand Dollars ($1,000.00).
      2.   Place a sign in direct view of such persons responsible for accepting customer payment for graffiti implements or paraphernalia stating as follows:
Selling spray paint, paint sticks, broad-tipped markers, or other graffiti implements or paraphernalia to persons under eighteen (18) years of age is against the law and punishable by a fine of not less than One Thousand Dollars ($1,000.00).
   C.   Identification: Every retail commercial establishment that offers for sale or trade graffiti implements or paraphernalia shall require a photographic form of identification to be produced by each person purchasing any graffiti implement or paraphernalia establishing that such person is eighteen (18) years or older.
