4-2-35: LIQUOR CATERER LICENSE:
   A.   Eligibility: Any party holding a present village of Pingree Grove liquor license for a licensed premises within the corporate limits of the village shall be eligible to apply for permission to serve as a liquor caterer. There shall be no additional fee for such licensure, and any licensee who seeks such permission shall be, after approval, entitled to operate within the conditions described in subsection D of this section. Application shall be on a form prescribed by the village clerk, and shall require approval of the village president with the recommendation of the chief of police.
   B.   Application; Fee; Investigation: Any party holding a valid state of Illinois liquor license and a liquor license issued by an Illinois municipal entity (city, town, village, county or similar entity) but not presently holding a village of Pingree Grove liquor license for a licensed premises within the village shall be authorized to apply for a liquor caterer's license. Application shall be on a form prescribed by the village clerk, and shall require approval of the village president with the recommendation of the chief of police.
      1.   There shall be a nonrefundable application fee of zero dollars ($0.00) applicable to initial license applications, and an annual licensure renewal fee of zero dollars ($0.00).
      2.   At the discretion of the chief of police, the applicant may be required to undergo such background investigation, fingerprinting, criminal history check and related inquiry as the chief shall determine to be appropriate, as a condition of consideration of licensure. The chief may also elect to undertake discussion with the municipal entity presently licensing the applicant and, based upon the nature of that discussion, may elect to waive the requirement of a separate background investigation.
      3.   The chief of police shall present a recommendation to the village president for consideration of approval. The president may either approve such recommendation, or refer the request to the liquor commission and village board for consideration and approval.
      4.   Upon approval, the licensee shall operate in accordance with the requirements of subsection D of this section.
   C.   Term Of License: The term of any liquor caterer license issued hereunder shall be coterminate with the term of all other village liquor licenses.
   D.   Conduct Of Licensed Caterer Events:
      1.   The licensee shall submit a written request for approval of a licensed caterer event to the village a reasonable time before the date of such event. Said application shall be on a form prescribed by the village clerk. The application shall be accompanied by the following items:
         a.   A floor plan showing the layout of the proposed event (including indoor or outdoor seating areas, fencing and access controls, proposed tents or temporary structures, and similar matters).
         b.   A letter from the property owner and a letter from the party conducting the event (if different from the property owner) consenting to the conduct of the event.
         c.   A copy of a certificate of insurance evidencing compliance with section 4-2-6 of this chapter relative to the proposed location of the event.
         d.   A description of the security plan for the event, including the number of trained liquor staff to be provided and the liquor access controls imposed.
         e.   The date, hours and location of the event, and the hours during which alcohol will be served (if different from hours of the event).
         f.   A description of the means of service of alcohol (open bar, tab bar, cash bar, other).
         g.   A written consent to the village police department entering the event at any time during its conduct, for the purpose of confirming compliance with the terms of the permit, village liquor code and applicable state regulations.
         h.   Such other information as the chief of police shall require.
      2.   For events conducted by or on behalf of a nonprofit, governmental or charitable organization, there shall be no fee. For all other events, there shall be a fee of zero dollars ($0.00) per application.
      3.   A single application and permit may cover an event lasting not longer than three (3) consecutive days.
      4.   Approval of a permit shall be required for the conduct of the event. Approval or rejection of the permit shall be provided by the chief of police. In the event that the chief of police rejects a permit, the applicant shall have the ability to appeal the rejection to the village liquor commission. The chief of police may condition approval of the permit on such conditions as the chief shall determine to be appropriate (e.g., approval of a third party, obtaining any required temporary utility or tent permits, etc.).
      5.   The applicant shall keep a copy of the approved permit at the licensed event during all times of alcohol sales.
      6.   During the hours of alcoholic beverage sales at the event, the village police department shall be authorized to enter the premises of the event without notice, for the purpose of inspecting the event and/or determining compliance with applicable regulations. Should any sworn member of the police department determine that the event is unlawful or presents a public safety hazard, such member shall be authorized to issue an emergency verbal revocation of the event permit. In such event, liquor sales shall terminate immediately and the event permit shall be forfeited.
      7.   Licensed events shall be permitted to have the sale of alcoholic beverages, in open containers, for consumption on the premises only. No sale of package beverages for consumption off premises shall be permitted. Licensees shall collect and pay all applicable taxes and charges related to such sales occurring within the village of Pingree Grove. (Ord. 2016-O-18, 6-6-2016)
