4-2-2: LOCAL LIQUOR CONTROL COMMISSION:
   A.   Established; Local Liquor Control Commissioner:
      1.   For purposes of the administration of this chapter, there is established a local liquor control commission that shall be charged with the administration of the laws of the state and the village pertaining to the sale of alcoholic liquor.
      2.   The village president is hereby designated as the local liquor control commissioner and shall be charged with the administration and empowered pursuant to the applicable state and federal laws and of such ordinances and resolutions relating to alcoholic liquor as may be passed from time to time by the board of trustees.
      3.   The village president, as local liquor control commissioner, shall be the chair and chief administrative officer of the local liquor control commission, which shall consist of three (3) members, including the village president and two (2) members of the board of trustees, who shall be appointed by the village president on an annual basis at the second regular village board meeting in April, with said appointments to become effective on May 1 immediately following the appointments.
      4.   For purposes of the initial creation of the local liquor control commission, the village president shall appoint two (2) village trustees to the local liquor control commission for an initial term to expire on April 30, 2010.
      5.   In the absence of the village president, one of the appointed members of the local liquor control commission shall be designated acting local liquor control commissioner and shall obtain the responsibilities of such office.
   B.   Authority And Actions:
      1.   The local liquor control commission shall have the authority to grant, suspend and/or revoke alcoholic liquor licenses in accordance with applicable state and federal laws, village ordinances and resolutions, and any rules and regulations established by and for said commission.
      2.   All official actions of any decisions by the local liquor control commission shall require a simple majority vote of those members present constituting a quorum. A quorum shall require the presence of not less than two (2) members of said commission.
      3.   The local liquor control commission shall have the right to examine, or cause to be examined, under oath, any applicant for a local license or for a renewal thereof, or any licensee upon whom notice of revocation or suspension has been served as provided by statute, and to examine the books and records of any such applicant or licensee, to hear testimony and take proofs for its information in the performance of its duties, and for such purpose, to issue subpoenas which shall be effective in any part of the state. For the purpose of obtaining any of the information desired by the local liquor control commission under this section, the commission may authorize its agent to act on its behalf.
   C.   Meetings: The local liquor control commission shall meet from time to time as may be necessary to carry forth its statutory duties, including, but not limited to, an annual meeting to review applications on the third Monday in April of each calendar year. (Ord. 2009-34, 10-5-2009)
