§ 150.34 FUNCTIONS AND CERTIFICATION AS ABANDONED URBAN PROPERTY, BLIGHTED PROPERTY, OR DETERIORATED PROPERTY.
   (A)   The Commission shall have the following functions:
      (1)   To determine whether a property is abandoned urban property or blighted property or deteriorated property when it has been referred to the Commission as tax delinquent or in violation of building regulations or in any respect meeting the standards set forth in this subchapter; and
      (2)   To investigate, research, and recommend to the Mayor and the City Council appropriate public policies and standards for the identification, protection, enhancement, and on-going use of historic sites, including, by way of illustration and without limitation:
         (a)   Polices, procedures, guidelines, ordinances, agencies, and the like that are useful and appropriate to designate historic sites, or that encourage or otherwise regulate appropriate alterations, rehabilitation, construction, preservation, or demolition of any building part of a historic site; and
         (b)   Polices, procedures, operating guidelines, or the like which assure full and fair opportunity for any property owner to be heard with respect to such matters.
   (B)   Certification of property as abandoned urban property or blighted property or deteriorated property may be made only after the following determinations have been made:
      (1)   The owner of the property or designated agent has been sent an order or notice by the appropriate city officer or agency to eliminate the conditions which are in violation of city building regulations or this subchapter;
      (2)   The property is vacant or unfit for human habitation;
      (3)   The property is abandoned urban property or blighted property or deteriorated property; and
      (4)   The Commission has notified the property owner or designated agent that the property has been determined to be abandoned urban property or blighted property or deteriorated property and the time period for correction of such condition has expired and the property owner or agent and any interested parties of record have failed to comply with the notice.
   (C)   Any property notified or cited under the provisions of Chapter 92 shall immediately be referred to the Commission in writing, with a copy of the notice pertaining thereto attached, by the officer or employee issuing such notice or citation. Nothing in this subchapter shall supersede by or otherwise modify the terms and application of any city ordinance now in effect including, by way of example and without limitation, Chapter 92 and the zoning ordinance for the city.
