§ 115.04 PERMIT AND LICENSE REQUIRED FOR YEARLY OPERATION.
   (A)   All mobile food vehicles and vendors must submit an application for a permit yearly to the City Clerk. The dual application will then be forwarded to the Mobile Food Vendors Committee for review.
   (B)   The grant of a permit may be subject to a monthly rotation of any designated “food zones” within the city.
   (C)   Although a permit allows for the operation of the food vehicles throughout the city limits, the permittee’s activity must occur in an area that is zoned for that type of an activity.
   (D)   Upon proper licensing and permitting, in full accordance with this chapter, all food truck vendors will be permitted access to city designated zones (i.e., public parking lots). The city reserves the right to close these zones temporarily at its discretion if necessary for maintenance and special events.
   (E)   No location within the city shall be approved that is within 500 feet of any existing restaurant during hours of operation of the existing restaurant.
   (F)   The applicant shall notify the City Clerk within 15 days of any changes to application information.
   (G)   The Mobile Food Vendors Committee shall not approve or re-approve a location where, in its sole discretion, a mobile food vehicle and/or mobile food vendor would substantially obstruct a public right-of- way, impair the movement of pedestrians or vehicles, or pose a hazard to public safety. Further, the Committee shall not approve or re-approve a location where, in its sole discretion, there is not adequate parking to serve the prospective permittees customers. It is recognized by the Council that parking in the downtown commercial area is limited and the location of mobile food vehicles or mobile food vendors competes with valuable parking spaces for which property owners compete and no permit will be issued for the downtown area except as approved by the Committee as part of a public festival or event.
   (H)   The Mobile Food Vendors Committee shall not approve any location which is adjacent to a bus stop, taxi stand, or handicap loading zone or directly in front of a property entry way.
   (I)   The grant of a permit hereunder shall not be deemed to authorize the conducting of mobile food vehicles and/or mobile vendors without the payment of the fee for a business license as is required under the current occupational license fee code. The permittee must subsequently obtain a business license from the City Clerk.
   (J)   Permits may be revoked immediately upon nonpayment of any occupational license fee or returns required by the occupations license fee code.
   (K)   The city does not believe that it is in the best interest of the city or its citizens to allow mobile food vehicles or mobile food vendors to operate on city streets, roads, highways, or rights-of-way and the Mobile Food Vendors Committee shall not issue any permits for these areas unless specifically approved by the city in connection with a public festival or event.
