§ 73.02 OPERATION OF MOTORCYCLES AND MOPEDS.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      MOPED. A pedal bicycle with a helper motor rated no more than two brake horsepower, a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged and capable of a maximum speed of not more than 30 mph.

      MOTORCYCLE. Any motor-driven vehicle having a seat or saddle for use of the operation and designed to travel on not more than three wheels in contact with the ground, but excluding tractors and vehicles on which the operator and passengers ride in an enclosed cab, and excluding a moped as defined in this section.
      OPERATOR. Any person in actual control of a motorcycle or moped.
   (B)   No motorcycle shall be permitted to operate in this city at a greater speed than that allowed or permitted for the operation of automobiles on the several streets and public passways in the city.
   (C)   The same rules and regulations and ordinances now in force and effect in the city as to the speed, observance of traffic signs, stops, and stop lights, and all other ordinances affecting automobiles and their traffic regulations are now extended to include motorcycles, including the penalties attached thereto for any violation thereof.
   (D)   No person shall operate a motorcycle:
      (1)   Except when that person is in possession of a valid motorcycle operators license;
      (2)   Unless that person uses an approved eye-protective device in the manner prescribed by the Secretary of the Department of Transportation at all times the vehicle is in motion; and
      (3)   Unless the motorcycle is equipped with a rearview mirror.
   (E)   No person shall operate or ride as a passenger on a motorcycle:
      (1)   Except on a seat permanently attached to that vehicle and specifically designed to carry the operator or passenger in a safe manner;
      (2)   Except when using a footrest permanently attached to that vehicle and specifically designed to carry that person in a safe manner; and
      (3)   Unless that person wears approved protective headgear, in the manner prescribed by the Secretary of the Department of Transportation, at all times that the vehicle is in motion.
