§ 152.561 INITIATION OF AMENDMENTS.
   (A)   Whenever a request to amend this chapter is initiated by the Board of Commissioners, the Planning Board, the Board of Adjustment, or the town staff, the Town Attorney (in consultation with the Planning Staff) shall draft an appropriate amending ordinance and shall present such amending ordinance to the Board of Commissioners so that a date for a public hearing may be set.
   (B)   Any other person may also request the Board of Commissioners to amend this chapter by filing a petition to the Land Use Administrator, and the petition shall include, among the information deemed relevant by the Land Use Administrator, the following:
      (1)   The name, address, and telephone number of the applicant;
      (2)   A description of the land affected by the amendment if a change in zoning district classification is proposed;
      (3)   Stamped envelopes containing the names and addresses of all those to whom notice of the public hearing must be sent as provided in § 152.568;
      (4)   A description of the proposed map change or a summary of the specific objective of any proposed change in the text of this chapter.
   (C)   Upon receipt of a petition as provided in division (B) above, the Land Use Administrator shall either:
      (1)   Treat the petition for a proposed amendment as one initiated by the town staff and proceed in accordance with division (A) above if it is believed that the proposed amendment has significant merit and would benefit the general public; or
      (2)   Forward the petition to the Board of Commissioners with or without written comment for a determination of whether an amending ordinance should be drafted and a public hearing set in accordance with division (D) below.
   (D)   Upon receipt of a petition for proposed amending ordinance as provided in division (A) above, the Board of Commissioners may establish a date for a public hearing. In the alternative, upon receipt of a petition for an amending ordinance as provided in division (B) above, the Board of Commissioners may summarily deny the petition or set a date for a public hearing and order the Town Attorney, in consultation with the Land Use Administrator and/or town staff, to draft an appropriate amending ordinance.
