(A) The Land Use Administrator is authorized to approve seasonal businesses (such as Christmas tree sales from Thanksgiving through Christmas, and firework sales beginning two weeks before July 4 through July 5) provided that sufficient plans are provided to the Land Use Administrator so that the Land Use Administrator can determine that the business may be operated in a safe manner. The normal requirements of this chapter shall not apply.
(B) The Land Use Administrator should consider parking access, setbacks from other uses and roads, whether normal sight lines of intersections and the like will be obstructed, and other similar considerations.
(C) Permits issued under this section must be renewed each year, and such permits are non-transferable.
(D) A fee of $25 shall be submitted along with the request for a permit, and the request shall include a minimal site plan which can be hand-drawn showing the location, all nearby streets, parking areas, other buildings, and the like.
(E) A denial of a permit requested hereunder shall be immediately appealable to the Board of Adjustment.
(F) Applicants are encouraged to make their applications in plenty of time to provide for an appeal prior to a holiday period.
