Whenever an amendment to this subchapter becomes effective after an application for a development permit is submitted but before the permit is issued and the effect of the amendment is to render the proposed development nonconforming, then the permit-issuing authority (Land Use Administrator, BOA, or BOC) may nevertheless issue the permit even though the project is nonconforming if the permit-issuing authority finds that the applicant has in good faith made substantial expenditures or incurred substantial binding obligations or otherwise changes his, her, or their position in a substantial manner in reasonable reliance on this subchapter as it existed prior to the amendment and thereby would be unreasonable prejudiced if required to comply with this subchapter as so amended.
