§ 30.03 TOWN ATTORNEY APPOINTMENT AND DUTIES.
   (A)   Appointment.
      (1)   At the first regular meeting following the election and qualifications of members, the Board shall reappoint the incumbent Town Attorney.
      (2)   The Town Attorney in place at the time of the initial meeting of a newly-elected Board of Commissioners shall be retained as Town Attorney until at least the second regularly scheduled meeting of the newly-elected Board of Commissioners.
      (3)   Should the newly-elected Board of Commissioners decide to appoint a new Town Attorney, such appointment may take place during or after the second regularly scheduled meeting of the newly-elected Board.

   (B)   Duties. It shall be the duty of the Town Attorney to:
      (1)   Prosecute and defend suits for and against the town;
      (2)   Advise the Mayor, Board of Commissioners, and other town officials with respect to the affairs of the town;
      (3)   Draft all legal documents relating to the affairs of the town;
      (4)   Inspect and pass upon all agreements, contracts, franchises and other instruments with which the town may be concerned; and
      (5)   Perform other duties required by law or as the Board of Commissioners may direct.
