§ 94.06 FUNDS FOR MAINTENANCE OF TOWN CEMETERIES.
   (A)   The sum of $25 from the sale of each grave site in the town’s cemetery shall deposited in a Perpetual Care Trust Fund for the perpetual care and beautification of the town’s cemetery premises. The remainder of the proceeds from the sale of any grave site shall be placed in a separate fund to be used for capital improvements, land acquisition, upkeep, opening and closing of graves, beautification and management of the town’s cemetery and any and all tools and equipment necessary for same.
   (B)   The town cemetery’s Perpetual Care Trust Fund shall be kept separate and apart from all other town funds and in no case utilized by the town for any purpose other than the care of the town’s cemeteries.
   (C)   It is the responsibility of the appropriate Commissioner to ensure that the appropriate upkeep, beautification, and management of the town’s cemetery are maintained.
