§ 90.999 PENALTY.
   (A)   A violation of the provisions of §§ 90.037, 90.039(A), 90.041(B), and 90.075 shall constitute a misdemeanor punishable as provided in G.S. § 14-4.

   (B)   (1)   A violation of any of the provisions cited in division (A) above, as well as §§ 90.003, 90.005, 90.020(A), 90.038(A), 90.039(E), 90.042, and 90.063 shall subject the offender to a civil penalty of $25. The penalty for a second violation of § 90.038(A) shall be $35, and for a third and subsequent violations, the penalty shall be $50. If the offender fails to pay any penalty within 15 calendar days after being cited for a violation. The penalty may be recovered by the town in a civil action in the nature of a debt.
      (2)   Each day that any violation continues after a person has been notified that such violation exists and that he, she, or they is subject to the penalties specified in divisions (A) and (B)(1) above shall constitute a separate offense.
      (3)   This chapter may also be enforced by any appropriate equitable action, including injunctions or orders of abatement.
      (4)   The town may enforce this chapter by any one or any combination of the foregoing remedies.

   (C)   (1)   In accordance with G.S. § 67-4.2, violation of § 90.040 is a misdemeanor punishable by a fine not to exceed $100 or imprisonment for not more than 30 days or both.
      (2)   In accordance with G.S. § 67-4.3, the owner of a dangerous dog that attacks a person and causes physical injuries requiring medical treatment in excess of $100 shall be guilty of a misdemeanor punishable by a fine of up to $5,000, imprisonment up to two years, or both.
      (3)   In accordance with G.S. § 67-4.4, the owner of a dangerous dog shall be strictly liable in civil damages for any injuries or property damage the dog inflicts upon a person, his, her, or their property, or other animal.
