§ 32.016 FEES AND COSTS FOR SERVICES PROVIDED TO NON-RESIDENTS.
   (A)   Whenever the Fire Department provides firefighting or emergency response services to or for the benefit of any person, business or other entity that is not a resident of the city, the Fire Chief shall be authorized to send a statement and collect fees for such services and to send a statement reimbursement of the cost of any materials or supplies used for firefighting and emergency response services provided to such persons, businesses or other entities that are not residents of the city. The charge for firefighting and emergency response services rendered by the city to persons, businesses or entities that are not residents of the city shall be computed at the rate of $250 per hour per vehicle and $70 per hour per firefighter responding to a call for assistance which the city deems to be an amount not exceeding the cost to the city for providing such services. An additional charge may be billed for reimbursement of the expense for materials or supplies used in rendering such services. No charge shall be made for services, supplies or materials for which the total statement would be less than $50. So long as the city and the Pinckneyville Rural Fire Protection District maintain any verbal or written agreement to provide mutual aid and assistance for the residents of their respective territories, the city shall not bill or collect fees for services rendered or reimbursement for materials provided within the city to or for the benefit of any person, business or other entity that is a resident of the Pinckneyville Rural Fire Protection District.
   (B)   In the event a statement issued pursuant to this section is not paid within 90 days after the date it is issued, the City Attorney is authorized to take such legal action as may be necessary to secure payment, including, but not limited to the filing of a civil action.
   (C)   This section does not require billing or collection of fees for firefighting or emergency response services provided by the city beyond the corporate limits of the city or to persons, businesses or entities that are not residents of the city if such services are provided by the city in accordance with the terms of a mutual aid agreement with another municipality or fire department.
