§ 52.065 CONNECTION TO SEWERAGE SYSTEM.
   (A)   The owner of any house, building or property served by the city’s waterworks system and located on any street, alley or right of way in which there is a public sewer line is hereby required, at his expense, to connect the house, building or property to the sewerage system, provided that the sewer line is within 100 feet of the property line. Every water customer shall also be billed for sewer service, regardless of whether or not such water customer is connected to the sewerage system, provided a sewer line is within 100 of the property line.
   (B)   Any person, firm, organization, corporation or association violating this section of this chapter shall be subject to a penalty of not less than $20 and not more than $500 and each day that the violation continues to an additional penalty of not less than $20 and not more than $500. A determination of a court that a violation of this section of this chapter has taken place and the assessment of a penalty therefore shall not preclude the city from seeking a recovery of any unpaid charges, fees or other sums due the city under this or other ordinances because of the furnishing by the city of its utility services.
