(A) The Mayor and City Clerk are authorized to procure and place in force water leak insurance coverage through Sunbelt Insurance Group to provide coverage for lost city revenue resulting from adjustments to customer water and sewer bills for customer water leaks.
(B) Effective with bills for city water and sewer services issued in October 2017, the city shall charge each water and sewer customer of city the sum of $ 1.40 per month to apply toward the premium cost of the water leak insurance coverage. Such monthly charge shall be in addition to the monthly charges for usage.
(C) Any water or sewer customer of the city who wishes to terminate or prevent the monthly charge for the water leak insurance premium may decline coverage and waive the right to request bill adjustments by signing and delivering to the City Clerk a written election to decline such coverage. The City Clerk shall provide an election form to any customer upon request. No charge for water leak insurance shall be added to any subsequent monthly bill for any water or sewer customer who provides the written election form to the City Clerk. City water and sewer customers who decline insurance coverage and who waive the right to request an adjustment to water and sewer bills shall remain responsible for payment of all water and sewer charges in full as shown by the metered usage as provided in § 52.051 of the City Code. Such customers shall not be entitled to any adjustment of excess charges resulting from leaks in customer’s service lines.
(D) For any city water and sewer customer who pays the monthly charge for the premium cost of water leak insurance, the customer may one time each twelve month period request an adjustment to the customer’s water and sewer bill and a reduction in “excess charges” resulting from leaks in customer’s water lines. The excess charges shall be calculated to equal the amount by which a monthly bill for water and sewer services exceeds the preceding 12 month average bill for such customer. The city as an exception to § 52.051 of the City Code will forgive one half the amount of such excess charges upon proof that customer has repaired the leak. The customer shall be responsible for payment of the remaining one half share of the excess charges, plus the charges equal to customer’s preceding 12 month average bill. Customer shall be entitled to an adjustment for charges arising from water leaks one time during each 12 month period. Any customer who is allowed an adjustment will cooperate with city to support the claim for benefits under the city’s water leak insurance coverage.
