§ 33.03 SERVICE CHARGE FOR UNPAID CHECKS.
   (A)   Definitions. For the purpose of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ACCOUNT. An amount owed the city for utility services, including, but not by way of limitation, water, sewer and natural gas and any amount which may be due as a fee or charge for other services provided by the city or any amount which may be assessed as fines or costs in any judicial or administrative proceeding in which the city is the plaintiff or moving party.
   ACCOUNT HOLDER. Any person having a checking account or savings account in a financial institution.
   DEBTOR. Any person, firm or corporation owing an account or responsible for paying an account to the city.
   FINANCIAL INSTITUTION. Any bank, savings and loan association, credit union, or other deposit of money, or medium of savings and collective investment.
   (B)   Whenever a check drawn upon any financial institution is issued or delivered to the city in payment of any account due the city and the check is not paid when presented to the financial institution upon which it is drawn, there shall be added to the account of the debtor an additional sum of $25 as a service charge as a result of the nonpayment of the check when presented.
