§ 96.07  LOT RULES AND REGULATIONS.
   (A)   All lots within the cemetery of the town and within any extension of the cemetery at any time hereafter made, shall be subject to and regulated and controlled by the provisions of this chapter and any rules adopted by the town.
      (1)   It shall be unlawful for any person, firm or corporation to be present in or to use the cemetery in any manner between sunset and sunrise without first obtaining authorization from the Town Administrator.
      (2)   It shall be unlawful for any person, firm or corporation to throw, deposit or otherwise place or cause to be thrown, deposited or otherwise placed on or in the cemetery any paper, glass, cans, garbage, trash or refuse of any kind other than in a properly designated refuse basket.
      (3)   No motorized vehicles, including but not limited to, automobiles, trucks, motorbikes, motorcycles, scooters or minibikes shall be allowed in or used in the cemetery except in the designated parking area.
   (B)   The following rules and regulations for the use of Sections 2 and 3 of the Pikeville Cemetery are hereby adopted.
      (1)   All head stones shall be placed as near as possible to the west lot line of each cemetery lot.
      (2)   All foot stones or foot markers shall be placed no more than eight feet from the west lot line of each cemetery lot so that there shall remain two feet of space that is available as a walkway at the east end of each cemetery lot.
      (3)   Cemetery lots which on the effective date of this division (B) become nonconforming with respect to the requirements set forth herein shall be brought into conformity within 90 days of the effective date of this division (B). If a lot is not brought into compliance within 90 days of the effective date of this division by the owner of the cemetery lot, then the town shall take such action as is necessary to bring the lot into compliance and the cost of bringing the lots into compliance shall be borne by the town.
      (4)   A copy of this division (B) shall be mailed by the Town Administrator to all owners of cemetery lots whose lots are not in compliance with the regulations adopted herein whose address can be reasonably determined by the Town Administrator.
      (5)   After the effective date of the ordinance passed 9-8-1992, mausoleums shall not be located on any lot other than lots 208, 209, 210, 211 and 213 of Section 3. No mausoleum already in place shall be required to be moved.
   (C)   In the event any provision of this chapter is violated by a corporation, the officer, agent or employee thereof who violates such provision or who procures, aids or abets such violation, shall be subject to the same penalties as if he or she himself or herself committed the violation.
   (D)   There shall be no trespassing within a buffer of 200 feet of any outer boundaries of the cemetery, except on the west side of the cemetery along Cemetery Road. This restriction shall include but not be limited to grave diggers, funeral home personnel and visitors to the cemetery, by any and all means of egress. There shall be no disbursing of dirt, nor discarding of trash or other noxious materials of the aforementioned 200-foot buffer.
