Judicial action (40 C.F.R. § 403.8(f)(1)(vi)) may take place for any violation of a town ordinance or any permit issued under this subchapter, in addition to situations where an order has been issued by the authority with respect to the conduct of a discharger contrary to the provisions of § 52.26 of this code, the attorney for the authority or the town may, following the authorization of such action by the Town Council, commence an action for appropriate legal and/or equitable relief in the appropriate local court.
