(A) Organization. The Sewage Department of the town is operated and managed under the control of the Town Council. Under state statutes, i.e., I.C. 36-9-23-1 et seq., municipal sewage works are supervised and controlled by the Town Council.

(B) Not a utility. By state statute, sewage works are not considered as a utility, however outside the technical legal use of the word, most people consider the Sewage Department as a form of utility.

(C) Independent. The “sewage works” or Sewage Department is generally considered as a separate business of the town and is independent of and from the General Fund of the town. Except for limited circumstances, the Sewage Department cannot add to or take away from the General Fund of the town.

(D) Policies. By state statute, some matters of the town sewage works must be determined by ordinance and by specific procedure. For matters not requiring ordinance, the Town Council may determine policies, rules and regulations by motion or resolution.
