(A) Organization. The Water Department of the town is under the control of the Town Council. (Water Departments such as that of the town are under the control of the “Works Board.” In towns, the Town Council also serve as the “Works Board,” as provided by state statute.)

(B) Independent. The Water Department is an independent department of the town. To generalize, the Water Department is treated as a separate business and except with respect to limited matters, the Water Department cannot take from or add to the General Fund of the town.

(C) Operation. The Town Council may by resolution or motion, in its capacity as the Board for the Water Department, adopt rules and policies governing the operation of the Water Department. There are, however, certain matters by state statute which require ordinances by the Town Council, and when such matters arise, the Town Council must follow the requirements of state law.

(D) Removal from jurisdiction of the state’s Utility Regulatory Commission. The waterworks utility of the town is hereby removed from the jurisdiction of the state’s Utility Regulatory Commission, with respect to the approval of rates and charges, and of the issuance of stocks, bonds, notes or other evidence of indebtedness.
