(A) Economic Development Commission created. There shall be and is hereby created for the town a Department of Development which shall be under the control of a Commission to be known as the town’s Economic Development Commission.

(B) Membership appointment.
(1) The town’s Economic Development Commission shall be composed of a membership of three Commission members who shall be appointed by the President of the Town Council as follows: One of the members so appointed shall be selected by the President of the Town Council; one shall be nominated by the County Council; and one shall be nominated by the Town Council.
(2) The three initial Commissioners shall take office upon their appointment, and their terms shall run the following number of years from February 1 following such original appointment: The Commissioner selected by the President of the Town Council shall serve for three years; the Commissioner nominated by the Town Council shall serve for two years; and the Commissioner nominated by the County Council shall serve for one year. Each succeeding Commissioner shall serve for a term of four years.

(C) Officers. The Commission shall elect one of its members as President, one as Vice President and one as Secretary, each of which officers shall serve from the date of his or her election until January 31 next following his or her election and until his or her successor is elected and qualified.

(D) Powers. The Commission shall have all of the rights, powers, privileges, duties and obligations conferred upon it by virtue of the provisions of I.C. 5-28-1-1 et seq., as amended, or as may be hereafter supplemented. The Commission shall also have such additional rights, privileges, duties, obligations and responsibilities as lawfully provided by any other statutes of the state.

(E) Meeting place. The Commission shall hold its meetings at the Town Hall in the town, or at such other place as the Commission itself shall determine from time to time.
