§ 90.16 ANIMAL CONTROL OFFICER; DUTIES.
   (A)   (1)   The animal control officer of the town shall, as soon as is expedient to the animal control officer, deliver any such animals picked up by him or her to the County Humane Society’s shelter. If the animal has been transferred to the County Humane Society’s shelter, then the fees provided in § 90.15 of this code shall not be required to be paid to the Clerk-Treasurer of the town, and any individual owning any such animal shall pay to the County Humane Society’s shelter the fees fixed by such shelter for the return of any such animal. Notwithstanding the foregoing, each time the animal control officer of the town transfers any such animal to the County Humane Society’s shelter, it shall be considered in determining the fees hereunder any subsequent time that the officer picks up such animal and holds the same.
      (2)   For example: If the animal control officer for the town shall pick up any animal for running at large and transfers such animal to the County Humane Society’s shelter, the owner of any such animal will pay the fees required of the County Humane Society’s shelter and shall not make any payment to the Town Clerk-Treasurer for holding of the animal. If such animal is picked up again by the animal control officer of the town, and the owner thereof appears to claim such animal, then the owner thereof would be required to pay the fee to the Town Clerk-Treasurer, which is required for the pick-up and holding of an animal the second time, i.e., $10.

   (B)   For the purpose of this subchapter, the Town Marshal, the Deputy Town Marshal and any person employed as animal control officer by the town, shall all be considered animal control officers of the town with the responsibilities and duties placed upon the animal control officer herein.
