(a) Upon the filing of an application for a sexually oriented business registration, the City Manager, or his or her designee, shall refer the application to the reviewing City departments for investigation to be made on the information contained in the application. The application process shall be completed within 30 days from the date of the City's receipt of the completed application. After the investigation, the City Manager, or his or her designee, shall issue a registration unless the requirements set forth in this chapter are not met.
(b) An applicant may appeal any decision of the City Manager, or his or her designee, denying an application to the Pickerington City Council. The applicant must file the appeal with the Clerk of Council within ten City of Pickerington business days after service of notice upon the applicant of the City Manager's, or his or her designee's, decision. The notice of appeal shall be accompanied by a memorandum or other writing setting out fully the grounds for such appeal and all arguments in support thereof. The City Manager, or his or her designee, may submit a memorandum in response if he or she so desires. After reviewing the memoranda, as well as the City Manager's, or his or her designee's, written decision, the City Council shall vote either to uphold or overrule the decision. City Council shall rule on the appeal within 30 days of its filing. All parties shall comply with the City Manager's, or his or her designee's, decision pending appeal.
