(a) The Board of Zoning Appeals shall consist of five members appointed by the Mayor with Council approval.
(b) The members of the Board of Zoning Appeals shall be freeholders and residents of the city. Three of the members shall have been residents of the city for at least ten years preceding the date of their appointment. No member of the Board of Zoning Appeals shall be a member of the Planning Commission nor shall any member hold any other elected or appointed office in the city government. Members of the Board shall serve without compensation, but shall be reimbursed for actual expenses incurred in the performance of their official duties.
(c) Upon creation of the Board of Zoning Appeals, the members shall be appointed for the following terms: one for a term of one year; two for a term of two years; and two for a term of three years. The terms shall expire on the January 1 of the first, second or third year respectively. Following appointments shall be for a period of three years.
(d) If a vacancy occurs, by resignation or otherwise, among the members of the Board of Zoning Appeals, the Mayor with Council approval shall appoint a member for the unexpired term.
(e) The Board of Zoning Appeals shall elect a Chairperson and Secretary from its members in July of each year. The Secretary shall have the authority to act as Chairperson during the absence or disability of the Chairperson.
