§ 1369.10 VIDEO LOTTERY AND GAMING ESTABLISHMENTS.
   (a)   “Video lottery or gaming establishment” means an establishment at which any form of gambling of chance is permitted or played, including “video lottery” machines licensed by the West Virginia Lottery Commission pursuant to W.Va. Code § 29-22B, but excluding establishments that only sell lottery tickets.
   (b)   Such establishments shall not be permitted in the historical area of the city and in all areas of the city zoned residential.
   (c)   All establishments located in the city shall be subject to the same parking requirements as a food service establishment.
   (d)   No establishment shall locate closer than 1,000 feet to another such establishment, a place of worship or school, measured as the shortest distance between any portion(s) of both buildings. For purposes of this section, a place of worship shall be defined as an institution which qualifies as tax exempt under the provisions of 26 U.S.C. § 501(c)(3), wherein weekly religious services are offered to the congregation and/or the general public.
   (e)   This section shall not apply to all establishments that are in operation in the city on the date of the adoption of this section.
