(a) “Refuse” means all sweepings, cleanings, trash, rubbish, litter, garbage, industrial or domestic waste; organic waste or the residue of animals, arising from the sale or use of meat, fruit or other vegetable matters from kitchens, dining rooms, market places dealing in or handling meats, fruits, vegetables or grain; offal, animal excreta, carcasses of animals, tree or shrub trimmings, grass clippings, dirt, wood, stone, brick, plater or materials resulting from the demolition, alteration or construction of buildings or structures, accumulated waste materials or substances which may become nuisances, some of which are more particularly classified as follows.
(1) “Prepared garbage” means waste materials from kitchen, dining rooms and similar places from which liquids have been drained and solid matter wrapped in paper.
(2) “Trash” means wastes materials contained in putrid matter or organic waste.
(3) “Ashes” means residue resulting from the combustion of coal, coke or wood in domestic, industrial or commercial stoves, furnaces or boilers, unless properly spread upon a garden plot or used as hard fill.
(b) “Refuse collections” means the gathering of refuse containers and of their contents from the premises of improved property and loading such contents into removing vehicles and returning containers to the place where found after contents have been emptied, for which charge is made as provided in § 951.04(a).
(c) “Refuse removal” means the hauling and transportation of refuse from point of collection to point of disposal.
(d) “Refuse disposal” means the disposition of refuse in accordance with rules and regulations promulgated by Council or as may set out in this article.
(e) “Refuse containers” or “trash and garbage containers” referred to in this article shall meet the following specifications:
(1) “Trash and ash containers” means standard containers for the storage of trash or ashes, which must be kept and contained in separate containers, shall be substantially made of metal, shall have a capacity of no more than 20 gallons, and shall be equipped with at least two carrying handles, with a tight-fitting metal cover, or as may be otherwise prescribed by the County Health Officer, or his or her authorized representative.
(2) “Garbage containers” means standard containers for the storage of garbage shall be substantially made of metal, leakproof and watertight, shall have a capacity of five gallons or more but not to exceed 30 gallons and shall be equipped with adequate bails or handles for carrying same with a tight- fitting metal cover, or as otherwise prescribed by the County Health Officer.
(f) “County Health Officer” means the County Health Officer of Barbour County, West Virginia, or his or her authorized representative, a registered professional sanitarian.
(g) “Person” means any individual, partnership, firm or corporation.
