§ 533.99 PENALTY.
   (a)   General penalty: whoever violates any provision of this article for which no other penalty is provided shall upon conviction be fined not more than $500. Each day such violation continues shall constitute a separate offense.
   (b)   Whoever violates § 533.05(b) shall upon conviction be fined not more than $200.
   (c)   Any person convicted of a violation of § 533.09 shall be subject to the following penalties:
      (1)   Upon a first conviction, the defendant shall be fined not less than $50 nor more than $250.
      (2)   Upon a second conviction, the defendant shall be fined not less than $250 nor more than $500.
      (3)   Upon any subsequent conviction in excess of a second conviction, the defendant shall be fined not less than $500 nor more than $1,000.
      (4)   Notwithstanding the provisions of W.Va. Code § 61-11A-4 or W.Va. Code § 50-3-2a, the magistrate or court may order restitution not to exceed the value of unauthorized solid waste services received.
