§ 105.06 FILING ANNOUNCEMENTS OF CANDIDACIES; REQUIREMENTS; FILING FEES.
   (a)   Any person who is eligible to hold office as Mayor or as a member of the Common Council may file a certificate with the City Clerk, declaring himself or herself a candidate for election to such office. Such certificate shall be substantially in the following form:
 
I,_______________, hereby certify that I am a candidate for election to the office of Mayor/Councilperson of ________ Ward, and desire my name printed on the ballot to be voted at the city election to be held on the_______ day of March, 20_____; that I am a legally qualified voter of the City of Philippi; that the address of my residence in the City of Philippi is ______________ that I am eligible to hold the office; and that I am a candidate therefor in good faith.

      (1)   Such announcement shall be signed and acknowledged by the candidate before some officer qualified to administer oaths, who shall certify the same.
      (2)   Such certificate shall be filed with the City Clerk not later than 30 days before the day of holding of the election, and must be received by the Clerk before midnight, eastern standard time, of that day or, if mailed, shall be postmarked before that hour; provided, however, that if the above set forth last day for filing is a Saturday or Sunday, such certificate shall be received by the Clerk before midnight, eastern standard time, of the following Monday, or, if mailed, shall be postmarked before that hour.
   (b)   Every person who becomes a candidate for election to office in any election, shall, at the time filing the certificate of announcement as required in this section, pay a filing fee as follows:
      (1)   A candidate for the office of Mayor shall pay a fee of $25, or another amount as set by Council from time to time;
      (2)   A candidate for the office of Councilperson shall pay a fee of $10, or another amount as set by Council from time to time; and
      (3)   A candidate for the office of City Clerk shall pay a fee of $25, or another amount as set by Council from time to time.
