§ 333.99 PENALTY.
   (a)   Whoever violates § 333.02 shall for a first offense be fined not less than $25 nor more than $500; for a second or subsequent offense shall be fined not less than $50 or more than $1,000.
   (b)   Notwithstanding the provisions of subsection (a) above, any person convicted of a violation of § 333.02 who in doing so proximately causes another to suffer serious bodily injury shall be fined not less than $50 nor more than $1,000.
   (c)   For purposes of subsection (b) above, “serious bodily injury” means bodily injury which creates a substantial risk of death, which causes serious or prolonged disfigurement, prolonged impairment of health or prolonged loss or impairment of the function of any bodily organ.
