§ 173.02 MUNICIPAL JUDGE; QUALIFICATIONS, TERMS AND THE LIKE.
   (a)   There shall be a judge, to be known as the Municipal Judge. Pursuant to the provisions of W.Va. Code § 8-10-2, Council shall appoint a qualified person to the office of Municipal Judge to serve at the will and the pleasure of Council. The Municipal Judge and Municipal Court shall have jurisdiction, exercise the powers and perform the duties specified for municipal courts and municipal judges respectively, as set forth in W.Va. Code §§ 8-10-1 and 8-10-2.
   (b)   A qualified person for the office of Municipal Judge must be a resident of the city and shall be an upstanding citizen of good moral character.
   (c)   In the case of the temporary absence of the Municipal Judge from the city or in the case of his or her inability to act from any cause or in case of a vacancy in the office of the Municipal Judge, the Municipal Court Clerk may act as Municipal Court Judge; provided, that the Municipal Court Clerk shall comply with the requirements set forth in W.Va. Code §§ 8-10-1 et seq.
   (d)   In the event of the death, resignation, removal or permanent disability of the Municipal Judge, Council shall appoint a qualified person to fill the vacancy of Municipal Judge.
