§ 1749.12 ABSOLUTE DEFENSE FOR CITY ACTION.
   It shall be an absolute defense to any civil action by an owner, landowner or tenant for damages resulting from the closure, demolition or other corrective action taken by a municipality under this section; provided, that the municipality acted in good faith, can demonstrate that the structure, dwelling or building falls within one of the categories set forth in § 1749.06(a) or (b), the municipality followed the procedures set forth herein and the municipality had adopted the State Building Code as adopted in Article 1747 at the time of the closure, demolition or other corrective action occurred.
